Contest Terms and Conditions

These Contest Terms and Conditions (“Terms”) include two sections: the Contest Details and the Official Rules.

The AXN Asia The Rookie 5 Fan Favourite Watch and Win Contest (“Contest”) is conducted by KC Global Media Singapore Pte. Ltd(“Promoter”) in connection with AXN Asia (“Channel”).By submittingan entry and therefore participating in the Contest, each eligible participant agrees to follow these Terms and to be bound by any decisions made by the Promoter, including any interpretations of these Terms.

OFFICIAL RULES

1. The Contest is only open to permanent residents of the Territory who are subscribers to the Channel (“Eligible Participant”). Eligible Participants must be aged eighteen (18) years old or above at the time of entry, to participate in the Contest.
2. Employees, agents, and promoters (including their immediate family members) of Promoter, and its affiliates, and others associated with the Contest, are not permitted to participate in the Contest.
3. Each person who enters into the Contest (“Participant”) in accordance with these Terms, agrees that they have read and understood these Terms and by participating in the Contest, each Participant agrees to be bound by and to comply with these Terms and represents and warrants that they are an Eligible Participant. Non-compliance with or breach of any of the Terms may disqualify a Participant and any prize won may be forfeited, withheld, withdrawn or reclaimed at the discretion of the Promoter.
4. Participants must use their own active, personal email account to enter and not any other account, including but not limited to, a work, third party or shared account. Participants must provide their current and valid postal address if requested on the registration form. Promoter reserves the right to request certain information or otherwise to verify such Participant’s personal email account and postal address.
5. Each Participant shall be entitled to enter the Contest once only. In the event of repeat submissions and/or entries, only the latest submission and/or entry will be eligible for consideration.
6. This Contest is in no way sponsored, endorsed or administered by, or associated with Instagram, X, Facebook, Meta or any other social media platform (“Social Platforms”). Any questions, comments or complaints regarding this Contest should be directed to the Promoter, not any Social Platforms.
7. The Promoter reserves the right to reject or disqualify any entry without prior notice for any reason, including but not limited to if the Promoter is notified or made aware that such entry violates the rights of any person whomsoever or is not in compliance with these Official Rules or any government regulations.

Winner Selection, Notification and Collection of Prizes

1. At the end of the Contest Period, Winners will be selected by Promoter from the Participants who have submitted eligible entries to the Contest. A designated representative of Promoter will select the Winners as set out in Winner Selection details in the Contest Details. The Promoter’s decision on the Winners will be final.
2. Promoter will notify the Winners as set out in Winner Announcement in the Contest Details.
3. If Promoter does not receive a reply from a Winner within three (3) working days after initial contact is made by Promoter using all reasonable efforts, except when such period is extended pursuant to local law or by Promoter at its discretion, that Winner will be disqualified. If a Winner is disqualified for this or any other reason, such as being found ineligible or failing to comply with these Terms, Promoter will select an alternate winner and the disqualified Winner will have no claim to any Prize.
4. The Prize must be redeemed in accordance with the notification message from the Promoter. If a Winner fails to respond in accordance with Promoter’s notification by the deadline specified in the notification, that Winner shall be deemed to have forfeited the Prize, and no further correspondence will be entertained under any circumstances.
5. Awarding of the Prizes may be conditional on the Winners signing an indemnity and release form provided by Promoter which shall release Promoter to the fullest extent permitted by law. In the event of non-compliance with this paragraph, the Winner(s) will be disqualified. Promoter reserves the right to select another Eligible Participant as a winner or to cancel the Prize.
6. Promoter shall not be deemed to be the seller or transferor of any Prize. The Prizes shall be subject to such other terms and conditions as may be imposed by the relevant sponsors, merchants and/or suppliers of the Prizes (“Prize Terms”). The Winners agree to be bound by such Prize Terms.
7. The Winners shall not directly or indirectly resell, attempt to resell and/or allow the resale of any Prize in any manner whatsoever. A breach of this clause shall constitute a material breach and shall entitle Promoter to immediately withdraw or reclaim the Prize upon notice to the Winner and without any liability on Promoter’s part.
8. Promoter reserves the right to redistribute any unclaimed Prizes to any other Eligible Participants or donate any unclaimed Prize or its equivalent value to the Community Chest in Singapore or any other approved charitable organization.
9. No Prize, or any part thereof, shall be transferable, exchangeable, redeemable or substituted for cash or any other benefits.
10. Promoter reserves the right, at any time in its sole and absolute discretion, to substitute, withdraw, add to or alter any Prize or any part thereof, without prior notice.

Entry Submission

1. In respect of any content submitted by a Participant to enter the Contest (including, without limitation, any entry form) (each a “Submission”), each Participant agrees to the following:
• No Submission shall directly or indirectly appear to or actually promote or advertise any person, entity, product or service other than the Participant, the Promoter or any of the Promoter’s affiliates;
• The Participant’s Submission/s shall be original and shall not make any unauthorized use of any third party’s copyright material, name, logo, trademark or service mark or infringe the intellectual property rights, privacy rights, publicity rights, or any other legal or moral rights of any third party;
• The Participant has received permission from any person whose likeness appears in any Submission, or from such person’s parent or legal guardian if such person is under 18 years of age;
• the Submission shall not contain any unlawful, defamatory, libelous, slanderous, obscene, sexually explicit, pornographic, violent, cruel, threatening, abusive, harassing, bullying, stalking, hateful, vulgar, racially or ethnically-motivated content, be invasive of another’s privacy, of poor quality, or otherwise objectionable, unfit for publication, posting, or other dissemination for public viewing, all of the above as determined by the Promoter in its sole discretion;
• No Submission shall make any visual or audio references implicitly or explicitly to alcoholic beverages, tobacco, drug paraphernalia, firearms, or any depiction or representation thereof, or be perceived as giving or threatening to give rise to criminal or civil liability, encouraging conduct that might constitute a criminal offense, or encouraging or providing instructional information about illegal activities; and
• All rights in and to each Submission (excluding references to the sponsors of this Contest (if any), the Promoter or any of its affiliates) shall be fully owned or otherwise controlled by the Participant.
2. By participating in the Contest, except where prohibited by applicable law, each Participant hereby grants to the Promoter, its affiliates, successors, licensees, assignees and authorized designees, a perpetual, fully-paid, royalty-free, transferable, fully sublicensable, worldwide, irrevocable, non-exclusive right and license to use, adapt, translate, reproduce, edit, modify, create derivative works from, combine with other works, post, transmit, perform, display, publish, communicate, communicate to the public, broadcast, reformat, make available, disseminate, distribute, and/or otherwise aurally and/or visually exploit (any one or more of the foregoing referred to as “Use”) any Submission, and the Participant’s name, likeness, image, photograph, voice, performance, rendering, signature, silhouette, sounds and/or biographical data contained therein and/or in the registration information accompanying the Participant’s Contest entry, in any media, manner, technology or content delivery mechanism now known or hereinafter devised, for any purpose, including, without limitation, in connection with the Contest, its administration, judging, advertising and/or publicity, and in connection with the promotion, advertising, publicity and/or other exploitation of Promoter, without the necessity of further consent or additional consideration.

Personal Data

1. By participating in the contest, each Participant acknowledges and agrees that the Participant has read, voluntarily consents to and opts into:
• the Promoter's privacy policy as available on its website (including, without limitation, in relation to the processing of the Participant’s personal data as set out in Promoter’s privacy policy) and terms of service; and
• at Promoter’s discretion, the receiving of marketing communications from Promoter and its affiliates. These communications may be sent by email, text, push notifications (if applicable) or other form of communication.
2. Each Participant further acknowledges that if they are chosen as a Winner, certain identifying information of the Participant may be disclosed to third parties for the purposes of administering the competition, including to make arrangements for the provision of the Prizes or as required by local laws and/or regulation, including, without limitation, the Participant’s full name and contact details.

Other matters

1. The Promoter and its agents, affiliates and/or representatives are not responsible for any loss of entries due to any problems caused by mobile devices or services, internet service providers or Social Platforms, for entries received after the deadline as a consequence of mobile service, internet service or Social Platform delays, mobile device issues, interruptions, failures or overloads, or for lost, stolen, misdirected, misplaced or corrupted entries. Entries are void if unreadable, inaccurate, incomplete, damaged, mutilated, tampered with, falsified, mechanically reproduced, irregular in any way or otherwise not in compliance with these Terms.
2. By participating in the Contest and/or accepting the Prize, each Participant releases, discharges and indemnifies and agrees to keep the Promoter, Social Platforms and any applicable third party media platforms used in connection with the Contest, and each of their respective affiliates, directors, officers, employees and agents, and all other associated with the development and execution of this Contest (collectively, the “Indemnified Parties”) indemnified against any and all claims, damages, losses, demands, causes of action, proceedings, costs, expenses, and/or liabilities resulting or arising from or connected with, or claimed to have arisen, resulted from or be connected with: (i) the Content, including Participant’s Submission, any awarding of a Prize, participation, attempt to participate, or inability to participate, in the Contest; (ii) use by the Indemnified Parties of any Submission (and/or any parts thereof); (iii) the Participant’s failure to comply with any one or more of these Terms or any applicable laws, rules or regulations; (iv) the unauthorized use by the Participant of, as applicable, the name, likeness, voice, work product, brand, trademark, logo of any person or entity; (v) the breach or alleged breach of any warranty, representation (including, without limitation any eligibility-related representation) or covenant made by the Participant in connection with the Contest; (vi) acceptance and/or use of any Prize; (vii) any right or benefit granted by the Participant to the Promoter in connection with the Contest; (viii) the Participant’s fraud, negligence, wilful misconduct, violation of any applicable laws, rules or regulations or these Terms, or violation of any third party’s intellectual property, privacy, publicity or other right; (ix) personal injury or damage to property, theft or loss suffered by the Winner and/or the Winner’s guests in connection with the use and/or enjoyment of the Prize; and/or (x) any tax liabilities in relation to the Contest, Prize and/or use or enjoyment of the Prize.
3. The Indemnified Parties make no representation, warranty or guarantee, expressed or implied, in fact or law, relative to any Prize, including but not limited to its quality, mechanical condition, fitness for any purpose or non-infringement.
4. Winners may be required to sign an indemnity and release form as a condition to the release of their Prize.
5. Promoter's decisions on the Contest and the Winners shall be final and no correspondence will be entertained under any circumstances. In the event of a dispute, any individual’s entitlement to participate in the Contest and any Participant’s entitlement to a Prize shall be subject to the sole discretion and final determination of the Promoter.
6. The Promoter is not responsible to the Winners for the redemption of the Prize or for any costs that are not specifically included in the Prize. The Promoter shall not be liable to any Winner for damages, losses, costs or expenses, lost profits, revenue, business or anticipated savings suffered or incurred by a Winner arising out of and/or in connection with the redemption of the Prize.
7. All taxes in connection with selections are the sole responsibility of each selected Winner, unless provided otherwise in accordance with applicable law and regulations.
8. The Promoter reserves the right to amend any of these Terms at any time and without notice. Participation in this Contest shall constitute acceptance of these Terms and any amendments thereof.
9. These Terms shall be governed by the laws of Singapore, save for the Contracts (Rights of Third Parties) Act. (Cap. 53B) which is expressly excluded from application. The parties agree to be bound by the non-exclusive jurisdiction of the courts of Singapore
