AXN UNIVERSITY CHALLENGE MALAYSIA 2017 OFFICIAL RULES
REVISED AS OF 5 MAY 2017

By registering for the AXN University Challenge Malaysia 2017 (the "Competition"), each participant agrees to follow these rules (the "Rules") and to be bound by any decisions made by AXN ASIA ("Channel") including any interpretation of these Rules.

The Competition comprises a qualifying challenge, semi-finals challenge and finals challenge and will be held at various locations in Klang Valley, Malaysia on the following dates and times:

The Channel may, for production, marketing and/or broadcasting purposes, take and use photographs, videos or audio recordings of the participants during the Competition. The Channel reserves the right to remove, take down and/or disqualify any entry or production materials without prior notice for any reason, including but not limited to if the Channel is notified or made aware that such entry is a repeated entry, violates the rights of any person whomsoever or is not in compliance with these Rules or any government regulations.

 

REGISTRATION

Registration for the qualifying challenge of the Competition may be submitted either:

  • online for the following venues only – Asia Pacific University, LimKokWing University, Multimedia University, SEGi University and Taylor's University; or
  • on-ground at all the venues of the qualifying challenge.

For the avoidance of doubt, online registrations do not apply for the qualifying challenge of the Competition at Sunway University.

Participants are allowed to register for only 1 qualifying challenge at any of the 6 venues as stated below. Participants who register for more than 1 qualifying challenge either online and/or on-ground at the venue of the qualifying challenge, will be automatically disqualified from participating in the Competition.

In order to be eligible to participate in the qualifying challenge for that venue, online registrations must be received by the Channel by the end of that venue's Online Registration Period (the "Online Registration Deadline") and on-ground registrations must be received by the end of that venue's On-Ground Registration Period ("On-Ground Registration Deadline"). Unless otherwise stated, any registrations received by the Channel after these registration deadlines shall be deemed invalid and void.

In order to register for the qualifying challenge, each participant must submit the information set forth below and agree to the Rules by completing and submitting the registration form at the Competition website (www.axn-asia.com/AXNUniChallenge) by the Online Registration Deadline or a designated booth at the respective venue of a qualifying challenge by the On-Ground Registration Deadline:

  • The participant's full name, month and year of birth, gender, email address, mobile number, t-shirt size, name of college or university that the participant attends, and venue of choice for the qualifying challenge.

For the qualifying challenge taking place at Asia Pacific University, LimKokWing University, Multimedia University, SEGi University and Taylor's University, only the first 300 participants to register online for each of such venue of the qualifying challenge by the Online Registration Deadline and the first 300 participants to register on-ground for each of such venue of the qualifying challenge by the On-Ground Registration Deadline, will be given the opportunity to run in the qualifying challenge for that venue. For the qualifying challenge taking place at Sunway University, only the first 600 participants to register on-ground at that venue by the On-Ground Registration Deadline will be given the opportunity to run in the qualifying challenge for that venue (collectively, the "Qualifying Participants"). Each Qualifying Participant who has registered at the Competition website (www.axn-asia.com/AXNUniChallenge) will be notified of their eligibility to participate by the designated representative of the Channel by way of e-mail at least one (1) day before the start date of the qualifying challenge for that venue.

Of the Qualifying Participants who are eligible to participate in the qualifying challenge of the Competition, only the fastest 20 participants from each venue with the shortest completion time of the obstacle course challenge in the qualifying challenge will proceed to the semi-finals challenge of the Competition. The remaining Qualifying Participants from each venue will be eliminated from the Competition ("Eliminated Participants"). Eliminated Participants are not allowed to register online for another qualifying challenge taking place at a later date or register on-ground at the venue of another qualifying challenge taking place at a later date and participate in such qualifying challenge of a later date. Such registration shall be automatically disqualified from the Competition. In the semi-finals challenge, the fastest 20 participants with the shortest completion time of the semi-finals challenge will proceed to the final challenge of the Competition and the remaining participants will be eliminated from the Competition. In the final challenge of the Competition, the fastest 3 participants with the shortest completion time of the obstacle course challenge in the final challenge will be declared the winners, the details of which are more fully set forth below.

 

COMPETITION INFORMATION

Prior to the start of the qualifying challenge:

(a) all Qualifying Participants notified of their eligibility to participate on or before the start of the qualifying challenge, must register their attendance on the day of that qualifying challenge and attend a briefing at a designated booth at the venue of that qualifying challenge in accordance with the briefing time as stated above;
(b) all Qualifying Participants who submitted their registration forms at the venue on the day of the qualifying challenge itself must attend a briefing at a designated booth at the venue at a time to be notified by the Channel.

All participants shall complete all of the documents or forms provided by the Channel, including an Indemnity and Release of Claims form, in a clear and concise manner. Any participant who fails to attend the said briefing and/or fails to complete any documents or forms provided by the Channel will be disqualified.

All participants are not permitted to use or carry any cash or electronic devices, including but not limited to, personal mobile phone, pager and radio, during the qualifying challenge, semi-finals challenge or the final round of the Competition unless otherwise approved by the Channel. All participants must surrender their electronic device(s) to the Competition marshal for the purposes of sealing such electronic device(s) into a designated bag. The participants are allowed to break the seal of the designated bag only for emergency purposes or at the end of their participation in the Competition.

Each participant will be given a score card. All participants are required to carry the score card at all times during their participation in the Competition. Any participant who is not carrying the score card may be disqualified.

Competition marshals shall be stationed at the start of and throughout each qualifying challenge, semi-finals challenge and final challenge of the Competition. The Competition marshals' responsibilities are as follows:

  • Remind the participants of any safety concerns with respect to the obstacle course challenge or challenge;
  • Ensure the participants compete in accordance with the Rules and any instructions from the Channel;
  • Record each participant's completion time upon completion of the obstacle course challenge or challenge; and
  • Upon a participant's request, certify the completion of the obstacle course challenge or challenge by the participant by stamping the participant's score card.

The Competition marshals are not responsible for ensuring the certification of the participant's score card upon the successful completion of the obstacle course challenge or challenge by the participant. It is the sole responsibility of the participant to ensure the score card is certified by the Competition marshal.

It is recommended that all participants should bring at least 1 set of clothes and 2 towels for the Competition. The Channel is not responsible for the provision of any towels or cleaning materials. All participants must ensure their proper hydration before and after their participation in the Competition.

If any participant feels unwell during the qualifying challenge, semi-finals challenge and the finals challenge, he/she must immediately discontinue his/her participation in the qualifying challenge, semi-finals challenge and the finals challenge and seek medical attention from medics at the venue.

A participant may withdraw from the Competition at any time by informing the Competition marshal or any other authorized personnel of the Competition. In such event, the participant shall surrender his/her score card to a Competition marshal or any other authorized personnel of the Competition.

The Channel may decide, at its sole discretion, if a participant cannot continue his/her participation in the Competition as a result of health, safety or any other reason.

Any discrepancies or problems with any of the obstacle course challenges or challenge discovered during the Competition must be reported to the Channel or its authorized personnel, including a Competition marshal. Any decision(s) made by the Channel shall be final and binding. The Channel will not entertain any further correspondence or appeal with respect to such decision(s).

The Channel reserves the right to disqualify any participant who (a) fails to abide by the Rules, (b) fails to follow any instructions of the Competition marshal or any other authorized personnel, or (c) behaves in a hostile or unacceptable manner to Channel towards any person or property at the Competition.

 

QUALIFYING CHALLENGE

The qualifying challenge of the Competition comprises of 3 mini obstacles / components. The following components comprise the obstacle course challenge:

  1. Thrilling – Each participant shall retrieve 10 cans of Mountain Dew from an ice box, and stack them up into a pyramid at a designated location within the obstacle course area. If a participant fails to complete this component in accordance with the directions of the Channel (including, but not limited to, if the cans are incorrectly stacked, or less than 10 cans are retrieved), he/she will be required to re-do the component, and for as many attempts required until he/she completes the component and to the satisfaction of the Competition marshal. Upon completion of this component, the participant shall proceed to the Mystery component.
  2. Mystery – Each participant shall assemble and solve a 12 piece jig-saw puzzle, which will reveal one of the 6 components of the final challenge's obstacle course challenge. Once the puzzle is assembled, the participant shall signal for a Competition marshal to verify if the assembled puzzle is correct to complete the obstacle course challenge. If a participant fails to complete this component in accordance with the directions of the Channel (including, but not limited to, if the puzzle is incorrectly pieced), he/she will be required to re-do the component, and for as many attempts required until he/she completes the component to the satisfaction of the Competition marshal. Upon completion of this component, the participant shall proceed to the Adventurous component.
  3. Adventurous – Each participant shall use a mini bicycle (without pedals) to get across an elevated plank, whilst keeping their feet off the ground. If a participant fails to complete this component in accordance with the directions of the Channel (including, but not limited to, falling off the bicycle, and/or if his/her feet touches the ground whilst getting across the elevated plank), the point at which that failure occurred and the time taken to that point shall be recorded by the Competition marshal. Each participant's finishing time shall be calculated from the time such participant commences the first component of the obstacle course challenge until (i) the time of his/her completion of the final component of the obstacle course challenge or (ii) in the event that the participant didn't complete the final component, the time to the furthest point reached by the participant.

Each participant will be offered the opportunity of one optional trial run of the Adventurous challenge prior to the start of the participant's qualifying challenge. The trial run will not be timed and the participant's performance during the trial run will not count in any way towards the participant's performance of the qualifying challenge.

Upon completion of the qualifying challenge, 20 participants from each venue (the "Semi-Finalists") shall proceed to the semi-finals challenge of the Competition.

The Semi-Finalists shall be the fastest 20 participants from that venue to complete the obstacle course challenge in the qualifying challenge.

In the event less than 20 participants complete the obstacle course challenge, the remaining Semi-Finalists shall be whoever got closest to the finishing line and in the event of a tie, whoever got to that point in the fastest finishing time. 

In the event of a tie-break to select the Semi-Finalists, the tied participants will be given a tie-breaker challenge to stack all 10 cans of Mountain Dew into a pyramid, and the selected Semi-Finalist(s) shall be whoever stacks all 10 cans of Mountain Dew into a pyramid in the fastest time. In the event of a further tie-breaker, the further tied participants shall be asked a tie-breaker question and will be given 3 minutes to write down their answer and submit it to the designated Competition marshal. The most creative and original answers shall be selected as the remaining Semi-Finalist(s) (as determined by the Channel at its sole discretion).

The Channel will announce the names at the venue of the 20 Semi-Finalists who will proceed to the semi-finals challenge, within an hour after the conduct of the qualifying challenge and tie breakers (if any). All decisions of the Channel are final and irrevocable.

 

SEMI-FINALS CHALLENGE

All Semi-Finalists of the Competition must report their attendance and attend a briefing at 8:30AM at a designated booth at the venue prior to the start of the semi-finals challenge of the Competition. Any Semi-Finalist who fails to attend the briefing will be disqualified from the Competition. All Semi-Finalists are required to wear a Competition T-shirt during their participation in the semi-finals challenge, and any Semi-Finalist who fails to wear the Competition T-shirt will be disqualified from the Competition.

The semi-finals challenge comprises of a wheel-barrow challenge. Each participant will be given a wheel-barrow and 28 cans of Mountain Dew at the starting point of the challenge. Participants must transport all 28 cans of Mountain Dew from the starting point to the finishing line, via a prescribed route that is demarcated by mini cones. Time penalties of 10 seconds shall be incurred by a participant for each toppled over mini cone. At the finishing line, participants must stack all 28 cans of Mountain Dew into a pyramid to complete the challenge. If a participant fails to complete the challenge in accordance with the directions of the Channel, he/she will be required to re-do the challenge, and for as many attempts required until he/she completes the challenge to the satisfaction of the Competition marshal. Upon completion of this challenge, the sum of the finishing time of such participant and all time penalties incurred (if any), shall be the official run time of that participant in the qualifying challenge of the Competition. Each participant's finishing time shall be calculated from the time such participant commences the semi-finals challenge until the time of his/her completion of the semi-finals challenge.

Upon completion of the semi-finals challenge, 20 participants (the "Finalists") shall proceed to the final challenge of the Competition.

The Finalists shall be the fastest 20 participants to complete the semi-finals challenge. 

In the event of a tie-break to select the Finalists, the tied participants will be given a tie-breaker challenge to stack all 28 cans of Mountain Dew into a pyramid, and the selected Finalist(s) shall be whoever stacks all 28 cans of Mountain Dew into a pyramid in the fastest time. In the event of a further tie-break, the further tied participants shall be asked a tie-breaker question and will be given 3 minutes to write down their answer and submit it to the designated Competition marshal. The most creative and original answers shall be selected as the remaining Finalist(s) (as determined by the Channel at its sole discretion).

The Channel will announce the names at the venue of the 20 Finalists who will proceed to the final challenge, within an hour after the conduct of the semi-finals challenge of the Competition. All decisions of the Channel are final and irrevocable.

 

FINAL CHALLENGE

All Finalists of the Competition must report their attendance and attend a briefing at a time to be notified by Channel at a designated booth at the venue prior to the start of the final challenge of the Competition. Any Finalist who fails to attend the briefing will be disqualified from the Competition. All Finalists are required to wear a Competition T-shirt during their participation in the final challenge, and any Finalist who fails to wear the Competition T-shirt will be disqualified from the Competition.

The final challenge comprises of an obstacle course challenge. Each participant will be given a maximum of 3 attempts to complete the obstacle course challenge. If a participant fails to complete the obstacle course challenge in accordance with the directions of the Channel or falls during any part of the obstacle course challenge on his/her 1st or 2nd attempt, he/she will be permitted to perform his/her subsequent attempt(s) of the obstacle course challenge starting from where he/she last failed or fell at. If by the end of the 3rd attempt the participant is unable to complete the obstacle course challenge, the furthest point reached by the participant and the time it took him/her to get there shall be recorded by the Competition marshal. Each participant's finishing time shall be calculated from the time the participant commences the first component of the obstacle course challenge until (i) the time of his/her completion of the obstacle course challenge or (ii) in the event that the participant didn't complete the obstacle course challenge the further point reached by the participant.

To illustrate the above, if on the first attempt, a participant falls on the 2nd component of the obstacle course challenge, he/she will be permitted to perform his/her 2nd attempt of the obstacle course challenge starting from the 2nd component of the obstacle course challenge. If by the end of his/her 2nd attempt, he/she falls again on the 5th component of the obstacle course challenge, he/she will be permitted to perform his/her 3rd attempt of the obstacle course challenge starting from the 5th component of the obstacle course challenge. If by the end of the 3rd attempt the participant is unable to complete the obstacle course challenge the furthest point reached by the participant and the time it took him/her to get there shall be recorded by the Competition marshal. If, however, on the 2nd attempt, the participant completes the obstacle course challenge, upon completion of the obstacle course challenge, the official finishing time of such participant shall be calculated from the time such participant commences the first component of the obstacle course challenge until the time of his/her completion of the final component of the obstacle course challenge.

The following components comprise the obstacle course challenge:

  1. Tight Ropes – Participants shall run up a wired ladder, and cross a suspended tight rope to retrieve a flag. The participant will descend the tight rope by a rope hanging by its side and proceed to the next component of the obstacle course challenge.
  2. Rope Up the Up Ramp – Participants will need to pull themselves up a slope ramp (of minimum 45 degrees) using only a rope, and retrieve a flag that is scattered across the ramp. Participants will descend from the other side the ramp and proceed to the next component of the obstacle course challenge.
  3. Hang Tough – Participants will need to pull themselves up onto a monkey bar, cross the monkey bars and retrieve a flag at the end before proceeding to the next component of the obstacle course challenge.
  4. The AXN Axle – Participants will need to get across a series of hurdles which vary in height. They will have to do so by climbing across or under each hurdle. Each participant must retrieve a flag at the end of the hurdles, before proceeding to the next component of the obstacle course challenge.
  5. Cargo Net – Participants will need to jump on to a cargo net, and climb under the net to get to the end and retrieve a flag before proceeding to the next component of the obstacle course challenge.
  6. Do The Dew – Participants will need to go through a series of mini obstacles on a bicycle (including, but not limited to an up ramp, cone route, height hurdles and ‘see saw' plank), whilst keeping their feet off the ground.

Upon completion of the final challenge, 3 participants will be declared the first prize winner, second prize winner and third prize winner ("Winners") of the Competition.

The Winners shall be the fastest 3 participants to complete the obstacle course challenge with all 6 flags collected.

In the event that less than 3 participants complete the obstacle course challenge with all 6 flags collected, the remaining Winners will be whoever got closest to the finishing line and in the event of a tie, whoever got to that point in the fastest finishing time.

The announcement of the Winners shall be made after the conduct of the final challenge of the Competition at the venue. The decisions of the Channel and/or its authorized representative, including, without limitation, with respect to the participants who are the Winners, shall be final and binding on all aspects of the Competition.

 

PRIZES

Winners of the Competition are eligible to win the following prizes:

  • The first prize winner will win a cash prize of MYR 5,000 and a race pack consisting of a bag, a Competition T-shirt, an AXN University Challenge first prize medal and various third party sponsor premiums (worth MYR 150).
  • The second prize winner will win a cash prize of MYR 3,000 and a race pack consisting of a bag, a Competition T-shirt, an AXN University Challenge second prize medal and various third party sponsor premiums (worth MYR 150).
  • The third prize winner will win a cash prize of MYR 1,000 and a race pack consisting of a bag, a Competition T-shirt, an AXN University Challenge third prize medal and various third party sponsor premiums (worth MYR 150).

All 120 Semi-Finalists of the Competition will each receive a race pack consisting of a bag, a Competition T-shirt, and various third party sponsor premiums (worth MYR 150), and all 20 Finalists will each receive an AXN University Challenge medal in addition to the race pack.

 

ELIGIBILITY AND CONDITIONS

  1. Participants must be citizens or legal residents of Malaysia.
  2. Participants must be 18 years old or older as of 21 April 2017, and must be a registered university student at any university in Malaysia.
  3. Each participant must present their identity card, matriculation card or any other documentary evidence with the participant's photograph for proof of age.
  4. By participating in the Competition, each participant must complete and sign the registration form and Assignment of Rights/Likeness Release/Indemnity Release form or any other forms/documentation as may be required by the Channel.
  5. Participants must be of sound physical condition, free of any type of bodily ailment and must not be pregnant. If, in any case, an individual is allowed by the Channel or its authorized personnel to participate, it is his/her responsibility to inform the Channel, its authorized personnel and his/her doctors of any possible factors that may trigger or aggravate a specific ailment. Participants must immediately inform the Channel in the event that such participant becomes injured during the Competition and immediately cease any activities that aggravate the injury.
  6. Each participant is responsible for his/her involvement in the Competition and is the sole judge of whether he/she should compete or continue to compete in the Competition. Any participant who is uncertain of his/her physical and/or mental capacity to participate in the Competition is advised to consult a registered doctor prior to his/her participation in the Competition.
  7. The Channel reserves the right, at its sole discretion, to reject or disqualify any participant's application if, in the Channel's opinion, the participant is deemed in any way: (i) unable or unfit to compete safely in the competition; (ii) likely to cause himself/herself injury and/or compromise the safety of other participants or the public during the Competition; and/ or (iii) if the Channel determines that such participant might damage the Channel brand. The Channel's decision shall be final and binding.
  8. It is recommended that each participant should have in effect, at his/her sole cost and expense, any accident and medical policies of insurance covering any personal injury, death or property damage as a result from the participation in the Competition.
  9. No purchase is necessary.
  10. Employees, agents, branches and promoters (including their immediate family members) of SPE Networks – Asia Pte. Ltd, and each of their divisions, affiliates and subsidiaries, and others associated with the Competition (including, but not limited to the Competition's sponsors and/or partners), are not permitted to participate in the Competition.
  11. The Channel and its agents, affiliates and/or representatives are not responsible for any loss of registrations due to any problems caused by internet service providers or registrations received after the deadline as a consequence of internet service delays, interruptions, failures, overloads or for misdirected emails. Any registration shall be deemed void if the information provided in such registration is inaccurate, incomplete, falsified or otherwise not in compliance with these Rules.
  12. By participating in the Competition, each participant acknowledges and agrees that: (a) the participant has opted-in to the Channel's Privacy Policy and Terms of Service on the Channel website page; and (b) by opting-in, the participant has read and voluntarily consents to the Channel's Privacy Policy (including, without limitation, the processing of his/her personal data as set out in the Channel's Privacy Policy) and Terms of Service. Each participant further acknowledges that if he/she is chosen as a prize winner, certain of his/her identifying information may be disclosed to third parties at least as required by law including, without limitation, on a winner's list.   13. Prizes cannot be transferred, negotiated or exchanged except that Channel reserves the right, in Channel's sole and absolute discretion, to substitute a prize or prize component of comparable or greater value.
  14. All selections will be made pursuant to these Rules. All taxes in connection with any participation in the Competition and receipt of any prizes are the sole responsibility of each participant, unless provided otherwise in accordance with applicable law and regulations.
  15. Where the Competition requires the participant to submit any content or information, by sending a submission, each participant agrees to the following eligibility requirements:
    • No submission shall directly or indirectly appear to or actually promote or advertise any person, entity, product or service other than the participant, the sponsors of this Competition, the Channel or any of the Channel's affiliates;
    • No participant shall make any trademark use or any other unauthorized use of any third party's name, logo, trademark or service mark in any submission or infringe the intellectual property rights, privacy rights, publicity rights, or any other legal or moral rights of any third party in any submission;
    • The participant has received permission from any person whose likeness appears in the submission, or from such person's parent or legal guardian if such person is under 18;
    • No submission shall contain any unlawful, defamatory, libelous, slanderous, infringing, obscene, sexually explicit, pornographic, violent, cruel, threatening, abusive, harassing, bullying, stalking, hateful, vulgar, racially or ethnically-motivated, or be of invasive of another's privacy, of poor quality, or otherwise objectionable, unfit for publication, posting, or other dissemination for public viewing element, all of the above as determined by the Channel in its sole discretion;
    • No submission shall make any visual or audio references implicitly or explicitly to alcoholic beverages, tobacco, drug paraphernalia, firearms, or any depiction or representation thereof, or be perceived as giving or threatening to give rise to criminal or civil liability, encouraging conduct that might constitute a criminal offense, or encouraging or providing instructional information about illegal activities; and
    • All rights in and to the submission (excluding references to the sponsors of this Competition, if any, the Channel or any of its affiliates) shall be fully owned or otherwise controlled by the participant.
  16. During the Competition at the Venues, participants warrant, undertake and agree that:
    • their performance shall not contain any content that is unlawful, defamatory, libelous, slanderous, infringing, obscene, sexually explicit, pornographic, violent, cruel, threatening, abusive, harassing, bullying, stalking, hateful, vulgar, racially or ethnically-motivated, or otherwise objectionable, unfit for publication, posting, or other dissemination for public viewing, all of the above as determined by the Channel in its sole discretion;
    • they shall not make any visual or audio references implicitly or explicitly to alcoholic beverages, tobacco, drug paraphernalia, firearms, or any depiction or representation thereof, or be perceived as giving or threatening to give rise to criminal or civil liability, encouraging conduct that might constitute a criminal offense, or encouraging or providing instructional information about illegal activities;
    • they shall be dressed appropriately. They are not allowed to be nude or wear anything that is too revealing or otherwise inappropriate;
    • they shall not bring to the Venues any volatile, explosive, toxic, radioactive, reactive, corrosive, easily flammable, or otherwise dangerous substances or engage in any dangerous activities as determined by the Channel in its sole discretion;
    • they shall not vandalise. The Channel has the right to require any participant who is found vandalizing to clean up, repair or replace the vandalized parts or items at his/her own cost; and
    • they shall not have consumed any intoxicating substances before or during the Competition, or be intoxicated during any part of the Competition.
  17. By participating in the Competition, except where prohibited by applicable mandatory law, each participant hereby grants to the Channel, its affiliates, successors, licensees, assignees and the Channel's authorized designees, a perpetual, fully-paid, royalty-free, transferable, fully sublicenseable, worldwide, irrevocable, non-exclusive right and license to use, adapt, translate, reproduce, edit, modify, create derivative works from, combine with other works, post, transmit, perform, display, publish, communicate, communicate to the public, broadcast, reformat, make available, disseminate, distribute, and/or otherwise aurally and/or visually exploit (any one or more of the foregoing referred to as "Use") any submission of content or information (if applicable) by the participant, and the participant's name, likeness, image, photograph, voice, performance, rendering, signature, silhouette, sounds and/or biographical data contained therein and/or in the registration information accompanying the participant's participation in the Competition, in any media, manner, technology or content delivery mechanism now known or hereinafter devised, for any purpose, including, without limitation, in connection with the Competition, its administration, judging, advertising and/or publicity, and in connection with the promotion, advertising, publicity and/or other exploitation of the Channel, without the necessity of further consent or additional consideration.
  18. By participating in the Competition, each participant shall be responsible, at his/her own costs, for arranging transportation, meals, accommodation and other incidental costs related thereto. The Channel will not be responsible in any manner whatsoever for any costs, expenses, losses or damages to participants or their property as a result of participating in this Competition.
  19. By participating in the Competition, each participant acknowledges and agrees that he/she is participating entirely at his/her own risk. The Channel will not be responsible in any way whatsoever howsoever for any loss, damage, injury, disability or death resulting from the Competition.
  20. The Channel reserves the right to amend any of these Rules at any time without notice to the participants and without any liability whatsoever. Participants must be in compliance with the Rules as amended at all times.
  21. The Channel has the right to disqualify any participant who fails to abide by these Rules or for reasonable cause at any time without any liability whatsoever.
  22. Awarding of the prize may be conditioned upon each of the winners signing any further documents as requested by the Channel. Failure to complete and sign any documents requested by the Channel may result in disqualification and selection of an alternate winner.
  23. Each participant shall fully indemnify and hold harmless the Channel and each of its divisions, affiliates, subsidiaries, directors, officers, employees and agents, including without limitation, Sony Corporation, Sony Corporation of America, Sony Pictures Entertainment Inc., CPT Holdings, Inc., and their respective subsidiaries, affiliates, employees, agencies and branches, as well as all Competition sponsors, if any, and all other associated with the development and execution of this Competition (collectively, the "Indemnified Parties") from any and all claims, damages, losses, demands, causes of action, proceedings, expenses, and/or liabilities resulting or arising from or connected with, or claimed to have arisen, resulted from or be connected with: (i) the participant's submission, participation, attempt to participate, or inability to participate, in the Competition; (ii) submission and/or Use by the Indemnified Parties of any submission (and/or any parts thereof); (iii) the participant's failure to comply with any one or more of the Rules or any applicable laws, rules or regulations; (iv) the unauthorized use by the participant of, as applicable, the name, likeness, voice, work product, brand, trademark, logo, or copyrighted material of any person or entity; (v) the breach or alleged breach of any warranty, representation (including, without limitation any eligibility-related representation) or covenant made by the participant in connection with the Competition; (vi) acceptance and/or use of any prize, if any; (vii) any right or benefit granted by the participant to the Channel in connection with the Competition; and/or (viii) the participant's negligence, willful misconduct, violation of any applicable laws, rules or regulations or these Rules, or his or her violation of any third party's intellectual property, privacy, publicity or other right.
  24. Participants release the Indemnified Parties from and against any and all liability with respect to or in any way arising from this Competition and the awarding and use, misuse or possession of any prizes, including liability for personal injury, except where prohibited or limited by law.
  25. The Competition is void where prohibited by law. All relevant national and local laws apply.
  26. This Competition shall be governed by and construed in accordance with the laws of the Republic of Singapore, without regard to choice of law principles. All actions or proceedings arising in connection with, touching upon or relating to this contest, the breach thereof and/or the scope of the provisions of this section shall be submitted to the Singapore International Arbitration Centre (the "SIAC") for final and binding arbitration in accordance with the Arbitration Rules of the Singapore International Arbitration Centre to be held in Singapore, in the English language, before a single arbitrator who shall be a retired judge. The arbitration shall be a confidential proceeding, closed to the general public. Prior to the appointment of the arbitrator or for remedies beyond the jurisdiction of the arbitrator, the Channel and/or SPE Networks – Asia Pte. Ltd. may seek equitable relief in a court of competent jurisdiction in Singapore or such other court that may have jurisdiction over the participant, without thereby waiving its right to arbitration of the dispute or controversy under this paragraph.

AXN UNIVERSITY CHALLENGE (PUBLIC CHALLENGE) MALAYSIA 2017 OFFICIAL RULES

By registering for the AXN University Challenge (Public Challenge) Malaysia 2017 (the "Competition"), each participant agrees to follow these rules (the "Rules") and to be bound by any decisions made by AXN ASIA ("Channel") including any interpretation of these Rules.

The Competition will be held at Sunway Pyramid, Selangor, Blue Entrance (outside Sunway Lagoon Entrance), 3 Jalan PJS 11/11, Bandar Sunway, 47500 Petaling Jaya, Selangor, Malaysia ("Venue") on 21 May 2017 from 10:30AM to 3:00PM.

The Channel may, for production, marketing and/or broadcasting purposes, take and use photographs, videos or audio recordings of the participants during the Competition. The Channel reserves the right to remove, take down and/or disqualify any entry or production materials without prior notice for any reason, including but not limited to if the Channel is notified or made aware that such entry is a repeated entry, violates the rights of any person whomsoever or is not in compliance with these Rules or any government regulations.

 

REGISTRATION

Prior to registration, all participants must obtain an 'Adventure Ticket' from a designated booth at the Venue, and participate in all 6 game booths at the Venue on 20 May 2017 or 21 May 2017. The Channel will certify the completion of each game booth by the participant by stamping the participant's Adventure Ticket. Participants must collect all 6 stamps and present the completed Adventure Ticket containing all 6 stamps for proof of participation in all game booths, upon registration at the Venue. The Channel is not responsible for ensuring the certification of the participant's Adventure Ticket upon the successful completion of a game booth by the participant. It is the sole responsibility of the participant to ensure the Adventure Ticket is stamped by the Channel.

Registration for the Competition must be submitted on-ground at the Venue of the Competition. In order to be eligible to participate in the Competition, on-ground registrations must be received by the end of the On-Ground Registration Period ("On-Ground Registration Deadline") as stated below. Unless otherwise stated, any on-ground registrations received by the Channel after the On-Ground Registration Deadline shall be deemed invalid and void.

In order to register for the Competition, each participant must submit a completed Adventure Ticket containing all 6 stamps (as stated above), submit the information set forth below and agree to the Rules by completing and submitting the registration form at a designated booth at the Venue of the Competition by the On-Ground Registration Deadline:

  • The participant's full name, month and year of birth, gender, email address, mobile number, and t-shirt size.

Only the first 30 participants to register on-ground at the Venue by the On-Ground Registration Deadline will be given the opportunity to run in the Competition (the "Qualifying Participants").

 

COMPETITION INFORMATION

Prior to the start of the Competition, all Qualifying Participants must attend a briefing at a designated booth at the Venue at a time to be notified by the Channel.

All participants shall complete all of the documents or forms provided by the Channel, including an Indemnity and Release of Claims form, in a clear and concise manner. Any participant who fails to attend the said briefing and/or fails to complete any documents or forms provided by the Channel will be disqualified.

All participants are not permitted to use or carry any cash or electronic devices, including but not limited to, personal mobile phone, pager and radio, during the Competition unless otherwise approved by the Channel. All participants must surrender their electronic device(s) to the Competition marshal for the purposes of sealing such electronic device(s) into a designated bag. The participants are allowed to break the seal of the designated bag only for emergency purposes or at the end of their participation in the Competition.

Each participant will be given a score card. All participants are required to carry the score card at all times during their participation in the Competition. Any participant who is not carrying the score card may be disqualified.

Competition marshals shall be stationed at the start of and throughout the obstacle course challenge in the Competition. The Competition marshals' responsibilities are as follows:

  • Remind the participants of any safety concerns with respect to the obstacle course challenge;
  • Ensure the participants compete in accordance with the Rules and any instructions from the Channel;
  • Record each participant's completion time upon completion of the obstacle course challenge; and
  • Upon a participant's request, certify the completion of the obstacle course challenge by the participant by stamping the participant's score card.

The Competition marshals are not responsible for ensuring the certification of the participant's score card upon the successful completion of the obstacle course challenge by the participant. It is the sole responsibility of the participant to ensure the score card is certified by the Competition marshal.

It is recommended that all participants should bring at least 1 set of clothes and 2 towels for the Competition. The Channel is not responsible for the provision of any towels or cleaning materials. All participants must ensure their proper hydration before and after their participation in the Competition.

If any participant feels unwell during the Competition, he/she must immediately discontinue his/her participation in the Competition and seek medical attention from medics at the Venue.

A participant may withdraw from the Competition at any time by informing the Competition marshal or any other authorized personnel of the Competition. In such event, the participant shall surrender his/her score card to a Competition marshal or any other authorized personnel of the Competition.

The Channel may decide, at its sole discretion, if a participant cannot continue his/her participation in the Competition as a result of health, safety or any other reason.

Any discrepancies or problems with any of the obstacle course challenge discovered during the Competition must be reported to the Channel or its authorized personnel, including a Competition marshal. Any decision(s) made by the Channel shall be final and binding. The Channel will not entertain any further correspondence or appeal with respect to such decision(s).

The Channel reserves the right to disqualify any participant who (a) fails to abide by the Rules, (b) fails to follow any instructions of the Competition marshal or any other authorized personnel, or (c) behaves in a hostile or unacceptable manner to Channel towards any person or property at the Competition.

 

OBSTACLE COURSE CHALLENGE

The Competition comprises of an obstacle course challenge. Each participant will be given a maximum of 3 attempts to complete the obstacle course challenge. If a participant fails to complete the obstacle course challenge in accordance with the directions of the Channel or falls during any part of the obstacle course challenge on his/her 1st or 2nd attempt, he/she will be permitted to perform his/her subsequent attempt(s) of the obstacle course challenge starting from where he/she last failed or fell at. If by the end of the 3rd attempt the participant is unable to complete the obstacle course challenge, the furthest point reached by the participant and the time it took him/her to get there shall be recorded by the Competition marshal. Each participant's finishing time shall be calculated from the time the participant commences the first component of the obstacle course challenge until (i) the time of his/her completion of the obstacle course challenge or (ii) in the event that the participant didn't complete the obstacle course challenge the further point reached by the participant.

To illustrate the above, if on the first attempt, a participant falls on the 2nd component of the obstacle course challenge, he/she will be permitted to perform his/her 2nd attempt of the obstacle course challenge starting from the 2nd component of the obstacle course challenge. If by the end of his/her 2nd attempt, he/she falls again on the 5th component of the obstacle course challenge, he/she will be permitted to perform his/her 3rd attempt of the obstacle course challenge starting from the 5th component of the obstacle course challenge. If by the end of the 3rd attempt the participant is unable to complete the obstacle course challenge the furthest point reached by the participant and the time it took him/her to get there shall be recorded by the Competition marshal. If, however, on the 2nd attempt, the participant completes the obstacle course challenge, upon completion of the obstacle course challenge, the official finishing time of such participant shall be calculated from the time such participant commences the first component of the obstacle course challenge until the time of his/her completion of the final component of the obstacle course challenge.

The following components comprise the obstacle course challenge:

  1. Tight Ropes – Participants shall run up a wired ladder, and cross a suspended tight rope to retrieve a flag. The participant will descend the tight rope by a rope hanging by its side and proceed to the next component of the obstacle course challenge.
  2. Rope Up the Up Ramp – Participants will need to pull themselves up a slope ramp (of minimum 45 degrees) using only a rope, and retrieve a flag that is scattered across the ramp. Participants will descend from the other side the ramp and proceed to the next component of the obstacle course challenge.
  3. Hang Tough – Participants will need to pull themselves up onto a monkey bar, cross the monkey bars and retrieve a flag at the end before proceeding to the next component of the obstacle course challenge.
  4. The AXN Axle – Participants will need to get across a series of hurdles which vary in height. They will have to do so by climbing across or under each hurdle. Each participant must retrieve a flag at the end of the hurdles, before proceeding to the next component of the obstacle course challenge.
  5. Cargo Net – Participants will need to jump on to a cargo net, and climb under the net to get to the end and retrieve a flag before proceeding to the next component of the obstacle course challenge.
  6. Do The Dew – Participants will need to go through a series of mini obstacles on a bicycle (including, but not limited to an up ramp, cone route, height hurdles and 'see saw' plank), whilst keeping their feet off the ground.

Upon completion of the obstacle course challenge, 3 participants will be declared the first prize winner, second prize winner and third prize winner ("Winners") and 10 participants will be declared the consolation prize winners ("Consolation Prize Winners") of the Competition.

The Winners shall be the fastest 3 participants to complete the obstacle course challenge with all 6 flags collected. In the event that less than 3 participants complete the obstacle course challenge with all 6 flags collected, the remaining Winners will be whoever got closest to the finishing line and in the event of a tie, whoever got to that point in the fastest finishing time. 

The Consolation Prize Winners shall be the next fastest 10 participants to complete the obstacle course challenge with all 6 flags collected. In the event that less than 10 participants complete the obstacle course challenge with all 6 flags collected, the remaining Consolation Prize Winners will be whoever got closest to the finishing line and in the event of a tie, whoever got to that point in the fastest finishing time.

The announcement of the Winners and Consolation Prize Winners shall be made after the conduct of the Competition at the Venue. The decisions of the Channel and/or its authorized representative, including, without limitation, with respect to the participants who are the Winners and Consolation Prize Winners, shall be final and binding on all aspects of the Competition.

 

PRIZES

Winners of the Competition are eligible to win the following prizes:

  • The first prize winner will win a cash prize of MYR 1,000 and a race pack consisting of a bag, a Competition T-shirt, a Competition medal and various third party sponsor premiums (worth MYR 150).
  • The second prize winner will win a cash prize of MYR 600 and a race pack consisting of a bag, a Competition T-shirt, a Competition medal and various third party sponsor premiums (worth MYR 150).
  • The third prize winner will win a cash prize of MYR 300 and a race pack consisting of a bag, a Competition T-shirt, a Competition medal and various third party sponsor premiums (worth MYR 150).

All 10 Consolation Prize Winners of the Competition will each receive a race pack consisting of a bag, a Competition T-shirt, and various third party sponsor premiums (worth MYR 150), and a Competition medal.

 

ELIGIBILITY AND CONDITIONS

  1. Participants must be citizens or legal residents of Malaysia.
  2. Participants must be 18 years old or older as of 21 May 2017, and must not have been a finalist in the AXN University Challenge Malaysia 2017 competition taking place on 20 May 2017. For the avoidance of doubt, participants who have previously participated in the AXN University Challenge Malaysia 2017 competition and have been eliminated from the qualifying challenge or semi-finals challenge of the AXN University Challenge Malaysia 2017 competition are permitted to participate in the Competition. 
  3. Each participant must present their identity card, or any other documentary evidence with the participant's photograph for proof of age.
  4. By participating in the Competition, each participant must complete and sign the registration form and Assignment of Rights/Likeness Release/Indemnity Release form or any other forms/documentation as may be required by the Channel.
  5. Participants must be of sound physical condition, free of any type of bodily ailment and must not be pregnant.  If, in any case, an individual is allowed by the Channel or its authorized personnel to participate, it is his/her responsibility to inform the Channel, its authorized personnel and his/her doctors of any possible factors that may trigger or aggravate a specific ailment. Participants must immediately inform the Channel in the event that such participant becomes injured during the Competition and immediately cease any activities that aggravate the injury.
  6. Each participant is responsible for his/her involvement in the Competition and is the sole judge of whether he/she should compete or continue to compete in the Competition. Any participant who is uncertain of his/her physical and/or mental capacity to participate in the Competition is advised to consult a registered doctor prior to his/her participation in the Competition.
  7. The Channel reserves the right, at its sole discretion, to reject or disqualify any participant's application if, in the Channel's opinion, the participant is deemed in any way: (i) unable or unfit to compete safely in the competition; (ii) likely to cause himself/herself injury and/or compromise the safety of other participants or the public during the Competition; and/ or (iii) if the Channel determines that such participant might damage the Channel brand. The Channel's decision shall be final and binding.
  8. It is recommended that each participant should have in effect, at his/her sole cost and expense, any accident and medical policies of insurance covering any personal injury, death or property damage as a result from the participation in the Competition.
  9. No purchase is necessary.
  10. Employees, agents, branches and promoters (including their immediate family members) of SPE Networks – Asia Pte. Ltd, and each of their divisions, affiliates and subsidiaries, and others associated with the Competition (including, but not limited to the Competition's sponsors and/or partners), are not permitted to participate in the Competition.
  11. The Channel and its agents, affiliates and/or representatives are not responsible for any loss of registrations due to any problems caused by internet service providers or registrations received after the deadline as a consequence of internet service delays, interruptions, failures, overloads or for misdirected emails. Any registration shall be deemed void if the information provided in such registration is inaccurate, incomplete, falsified or otherwise not in compliance with these Rules.
  12. By participating in the Competition, each participant acknowledges and agrees that: (a) the participant has opted-in to the Channel's Privacy Policy and Terms of Service on the Channel website page; and (b) by opting-in, the participant has read and voluntarily consents to the Channel's Privacy Policy (including, without limitation, the processing of his/her personal data as set out in the Channel's Privacy Policy) and Terms of Service. Each participant further acknowledges that if he/she is chosen as a prize winner, certain of his/her identifying information may be disclosed to third parties at least as required by law including, without limitation, on a winner's list.     • they shall not bring to the Venues any volatile, explosive, toxic, radioactive, reactive, corrosive, easily flammable, or otherwise dangerous substances or engage in any dangerous activities as determined by the Channel in its sole discretion;
    • they shall not vandalise. The Channel has the right to require any participant who is found vandalizing to clean up, repair or replace the vandalized parts or items at his/her own cost; and
    • they shall not have consumed any intoxicating substances before or during the Competition, or be intoxicated during any part of the Competition.
  17. By participating in the Competition, except where prohibited by applicable mandatory law, each participant hereby grants to the Channel, its affiliates, successors, licensees, assignees and the Channel's authorized designees, a perpetual, fully-paid, royalty-free, transferable, fully sublicenseable, worldwide, irrevocable, non-exclusive right and license to use, adapt, translate, reproduce, edit, modify, create derivative works from, combine with other works, post, transmit, perform, display, publish, communicate, communicate to the public, broadcast, reformat, make available, disseminate, distribute, and/or otherwise aurally and/or visually exploit (any one or more of the foregoing referred to as "Use") any submission of content or information (if applicable) by the participant, and the participant's name, likeness, image, photograph, voice, performance, rendering, signature, silhouette, sounds and/or biographical data contained therein and/or in the registration information accompanying the participant's participation in the Competition, in any media, manner, technology or content delivery mechanism now known or hereinafter devised, for any purpose, including, without limitation, in connection with the Competition, its administration, judging, advertising and/or publicity, and in connection with the promotion, advertising, publicity and/or other exploitation of the Channel, without the necessity of further consent or additional consideration.
  18. By participating in the Competition, each participant shall be responsible, at his/her own costs, for arranging transportation, meals, accommodation and other incidental costs related thereto. The Channel will not be responsible in any manner whatsoever for any costs, expenses, losses or damages to participants or their property as a result of participating in this Competition.
  19. By participating in the Competition, each participant acknowledges and agrees that he/she is participating entirely at his/her own risk. The Channel will not be responsible in any way whatsoever howsoever for any loss, damage, injury, disability or death resulting from the Competition.
  20. The Channel reserves the right to amend any of these Rules at any time without notice to the participants and without any liability whatsoever. Participants must be in compliance with the Rules as amended at all times.
  21. The Channel has the right to disqualify any participant who fails to abide by these Rules or for reasonable cause at any time without any liability whatsoever.
  22. Awarding of the prize may be conditioned upon each of the winners signing any further documents as requested by the Channel. Failure to complete and sign any documents requested by the Channel may result in disqualification and selection of an alternate winner.
  23. Each participant shall fully indemnify and hold harmless the Channel and each of its divisions, affiliates, subsidiaries, directors, officers, employees and agents, including without limitation, Sony Corporation, Sony Corporation of America, Sony Pictures Entertainment Inc., CPT Holdings, Inc., and their respective subsidiaries, affiliates, employees, agencies and branches, as well as all Competition sponsors, if any, and all other associated with the development and execution of this Competition (collectively, the "Indemnified Parties") from any and all claims, damages, losses, demands, causes of action, proceedings, expenses, and/or liabilities resulting or arising from or connected with, or claimed to have arisen, resulted from or be connected with: (i) the participant's submission, participation, attempt to participate, or inability to participate, in the Competition; (ii) submission and/or Use by the Indemnified Parties of any submission (and/or any parts thereof); (iii) the participant's failure to comply with any one or more of the Rules or any applicable laws, rules or regulations; (iv) the unauthorized use by the participant of, as applicable, the name, likeness, voice, work product, brand, trademark, logo, or copyrighted material of any person or entity; (v) the breach or alleged breach of any warranty, representation (including, without limitation any eligibility-related representation) or covenant made by the participant in connection with the Competition; (vi) acceptance and/or use of any prize, if any; (vii) any right or benefit granted by the participant to the Channel in connection with the Competition; and/or (viii) the participant's negligence, willful misconduct, violation of any applicable laws, rules or regulations or these Rules, or his or her violation of any third party's intellectual property, privacy, publicity or other right.
  24. Participants release the Indemnified Parties from and against any and all liability with respect to or in any way arising from this Competition and the awarding and use, misuse or possession of any prizes, including liability for personal injury, except where prohibited or limited by law.
  25. The Competition is void where prohibited by law. All relevant national and local laws apply.
  26. This Competition shall be governed by and construed in accordance with the laws of the Republic of Singapore, without regard to choice of law principles. All actions or proceedings arising in connection with, touching upon or relating to this contest, the breach thereof and/or the scope of the provisions of this section shall be submitted to the Singapore International Arbitration Centre (the "SIAC") for final and binding arbitration in accordance with the Arbitration Rules of the Singapore International Arbitration Centre to be held in Singapore, in the English language, before a single arbitrator who shall be a retired judge. The arbitration shall be a confidential proceeding, closed to the general public. Prior to the appointment of the arbitrator or for remedies beyond the jurisdiction of the arbitrator, the Channel and/or SPE Networks – Asia Pte. Ltd. may seek equitable relief in a court of competent jurisdiction in Singapore or such other court that may have jurisdiction over the participant, without thereby waiving its right to arbitration of the dispute or controversy under this paragraph.
